Sentence Review Division
The Sentence Review Division (Division) of the Supreme Court is comprised of three District Court judges appointed by the Chief Justice of the Supreme Court for three-year terms.
Individuals sentenced to the Montana State Prison, the Montana Women's Prison or to the Department of Corrections (DOC) for one year or more, wherein they are actually taken into custody, may request a review of the sentence they received from a District Court.
The Division meets four times a year in Deer Lodge at the Montana State Prison and twice a year in Billings at the Montana Women's Prison. The 2006 members were: Honorable John Whelan, Chairman; Honorable Randal Spaulding; and Honorable Katherine Irigoin. The alternate judge was Honorable Kurt Krueger.
In 2006, the Division received a total of 188 Applications for Review of Sentence. Of the sentences reviewed, 49 were affirmed; 11 were decreased; and 0 were increased. One of the applications was decreased in incarceration time and increased in suspended time. Of the remaining applications, 53 were dismissed upon request of the defendant; 48 were carried over into 2007; 24 were held in abeyance pending the outcome of an appeal; and 2 were remanded back to the District Court. There were 6 applications from 2005 that were continued and carried over to 2007.
